Nesi User Agreement

1. Service Overview

Nesi is a mobile application designed to provide users with a one-click natural water glow skin effect for matte skin portraits. The app adds subtle highlights to the forehead, nose bridge, and cheekbones, creating a non-greasy, natural dewy finish. By downloading, installing, or using Nesi, you agree to be bound by this User Agreement.

Nesi reserves the right to modify, suspend, or discontinue any part of the service at any time without prior notice, except as required by applicable laws.

2. Account Rules

• You must provide accurate and complete information when creating an account and keep it updated.
• You are solely responsible for maintaining the confidentiality of your account credentials and all activities under your account.
• You agree not to share, sell, or transfer your account to any third party without Nesi's prior written consent.
• Nesi reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.

3. Usage Guidelines

You agree to use Nesi only for lawful, personal, and non-commercial purposes. Prohibited uses include, but are not limited to:

• Using the app to create, upload, or share content that infringes on the intellectual property rights of others.
• Using the app for illegal, harmful, or offensive activities, including harassment, defamation, or privacy violations.
• Attempting to reverse engineer, decompile, or modify the app's source code or functionality.
• Using automated tools or bots to access or manipulate the app's services.

4. Content Rights and Responsibilities

You retain all ownership rights to the original photos you upload to Nesi. By uploading content, you grant Nesi a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the app's services.

You represent and warrant that you have all necessary rights, licenses, and permissions to upload and process your content through Nesi, and that such content does not violate any third-party rights or applicable laws.

Nesi does not claim ownership of your processed content but reserves the right to remove any content that violates these terms or applicable laws.

5. Payment Terms

• Nesi offers both free and premium subscription services. Premium features require payment of a subscription fee.
• Subscription fees are charged on a recurring basis (monthly/annual) as selected by you, and will auto-renew unless you cancel at least 24 hours before the end of the current billing period.
• All payments are processed through third-party payment platforms, and you agree to their respective terms of service.
• Subscription fees are non-refundable, except as required by applicable law or as explicitly stated in Nesi's refund policy.
• Nesi reserves the right to change subscription fees at any time, with prior notice to users.

6. Service Modification and Termination

Nesi may modify, update, or discontinue any part of the service, including features, content, or pricing, at its sole discretion. We will provide reasonable notice of material changes to the service, except in cases of emergency or legal requirement.

You may terminate your use of Nesi at any time by uninstalling the app and canceling any active subscriptions. Nesi may terminate your access to the service immediately for violations of this agreement, without prior notice.

Upon termination, your right to use the service ceases, and Nesi may delete your account data and content in accordance with its privacy policy.

7. Disclaimer of Warranties

NESI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NESI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nesi does not warrant that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use the service at your own risk.

8. Limitation of Liability

IN NO EVENT SHALL NESI, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF NESI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NESI'S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO NESI FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM.

9. Dispute Resolution

Any disputes arising out of or related to this agreement or the use of Nesi shall first be resolved through good-faith negotiations between you and Nesi. If negotiations fail, disputes shall be settled by arbitration in accordance with the rules of the relevant arbitration institution, or by the courts of the jurisdiction where Nesi is located, as applicable.

This agreement shall be governed by the laws of the jurisdiction where Nesi operates, without regard to its conflict of law principles.

10. Agreement Updates

Nesi reserves the right to update or modify this User Agreement at any time. Material changes will be notified to users through the app or via email. Your continued use of Nesi after the effective date of the updated agreement constitutes your acceptance of the changes.

It is your responsibility to review this agreement periodically for updates. If you do not agree to the modified terms, you must stop using Nesi immediately.
